Written claim of patrimonial responsibility for damages derived from a legislative act

Last year we made an appeal to the members of our platform to submit to the Consejería de Tursimo of the Government of the Canary Islands a written claim for liability. We understand that the modification of the Law of Renovation and Tourist Modernization of the Canary Islands introduced in the Land Law of July 2017, although it gave some security to those residential uses existing before January 1st, 2017, also established a limitation that did not exist before, limiting the free transition between residential and tourist uses of properties as had been done previously and, therefore, reducing the value of our properties.
Those of us who present this claim are receiving a legal report evacuated by the Consejería and we are awaiting the final response in the resolution of the procedure. We understand that this report does not correspond to the reality of the entire legal system, pouring some partial and prejudicial conclusions on the claim that is made, so we have decided that all those who initiated such a claim (both for houses in tourist use and those who are making a residential use) submit the letter that we provide with considerations that we value of vital importance to defend our rights and that we want to be taken into account before resolving the claim.
